INFORMATIVA PRIVACY ai sensi dell'art. 13, del Regolamento UE in materia di protezione dei dati personali n. 679/2016 (“GDPR”)

Modenatur scarl, gestore dell'Ufficio Informazione e accoglienza turistica del Comune di Modena, con sede legale in Via Scudari 10 a Modena, è il titolare del trattamento dei dati che vengono raccolti in occasione dell'utilizzo del servizio di Live Chat integrato su Visitmodena.it. Modenatur la informa che l’utilizzo dei dati personali di cui è in possesso avviene in ottemperanza a quanto previsto dal GDPR ed è improntato ai principi di correttezza, liceità, trasparenza e alla tutela della riservatezza dei soggetti cui i dati si riferiscono. Con il presente documento Modenatur le fornisce indicazioni relative alla tipologia dei dati raccolti attraverso la chat. Il Comune di Modena, proprietario del sito www.visitmodena.it non tratta alcun dato che viene comunicato durante la livechat e non registra alcun dato sui propri server.

BASE GIURIDICA DEL TRATTAMENTO E NATURA DEI DATI. I dati personali sono forniti con la compilazione del form (“inizia la chat” o “lascia un messaggio”) direttamente dall’Interessato (come nome e indirizzo e-mail) e sono trattati dal Titolare in conformità al GDPR – esclusivamente per rispondere alle richieste poste dall’Interessato medesimo. La base giuridica del trattamento è la necessità di fornire riscontro all’Interessato richiedente. Il conferimento dei dati è facoltativo ma l'eventuale rifiuto comporta l'impossibilità, da parte di Modenatur di rispondere alle richieste ricevute. I dati derivanti dalla conversazione in chat saranno inviati all’Utente successivamente all’indirizzo e-mail indicato.I dati non saranno utilizzati per comunicazioni successive alla chiusura della richiesta di informazioni relative alla chat e non saranno inseriti in mailing list o newsletter promozionali a meno che l’interessato non lo richieda esplicitamente e ne autorizzi l’utilizzo accettando apposita informativa privacy.

CATEGORIA DI SOGGETTI AI QUALI I DATI POSSONO ESSERE COMUNICATI E DIFFUSIONE

I dati personali non saranno diffusi e potranno essere comunicati a società contrattualmente legate a Modenatur al fine di ottemperare alla finalità per cui sono stati raccolti. I dati possono essere comunicati a:soggetti nominati responsabili dal Titolare per la fornitura del software livechat;personale del Titolare che effettua attività di trattamento in qualità di soggetti autorizzati dal Titolare medesimo.L’elenco dei responsabili è disponibile presso la sede del Titolare o scrivendo all’ indirizzo e-mail: info@modenatur.it. I dati personali non saranno trattati al di fuori dell’Area UE (EEA).

MODALITÀ DEL TRATTAMENTO, CONSERVAZIONE DEI DATI E LUOGO DEL TRATTAMENTO

Il trattamento dei dati personali è svolto in forma automatizzata e manuale, con modalità e strumenti volti a garantire la massima sicurezza e riservatezza, ad opera di soggetti appositamente incaricati in ottemperanza a quanto previsto agli artt. 28 e 29 del GDPR.Ai sensi di quanto previsto dall’art. 5 par. 1 lett. e) del GDPR, i dati personali dell’Interessato sono conservati in una forma che ne consenta l’identificazione per un periodo di tempo non superiore al conseguimento della finalità per la quale i dati sono stati raccolti e successivamente trattati e, comunque, non oltre 24 mesi dal termine della conversazione tramite chat, fatti salvi gli eventuali casi di conservazione per obblighi di legge. DATI RELATIVI AI MINORI DI ANNI 16 I minori di 16 anni non possono fornire dati personali. Il Titolare del trattamento non sarà in alcun modo responsabile di eventuali raccolte di dati personali, nonché di dichiarazioni mendaci, fornite dal minore, e in ogni caso, qualora se ne ravviserà l’utilizzo, il Titolare agevolerà il diritto di accesso e di cancellazione inoltrato da parte del tutore, affidatario o da chi ne esercita la responsabilità genitoriale
